Welcome to our online bake sale site. Here is where you can place your online preorders for all of our treats for our Weekly bake sale. Preorders with payment reserve your treats and guarantee you will get yours. Orders are held for 30 minutes after scheduled pick up time . If it is a restock day, you have between 5pm-8pm on restock day and 5pm-8pm the next day. If you miss both days without contacting us, your order will be cancelled. We will not remake your order due to late pick up . Non pickup orders will be sold to the next customer. If for any reason you cannot pick up your order please call us at (203)-626-2456 to inform us and possibly set up a delivery if available. Since orders are made fresh to order, we do not offer refunds. Delivery fees range from $3-$10 depending on location. delivery is not always available, delivery is normally advertised in our bake sale flyer. Ordering
All orders are to be placed no later than 4 weeks PRIOR to requested pick up date.
Orders are NOT confirmed until a retainer payment is paid.
Retainer payments secure your order date.
Order changes
Changes to order can ONLY be made 2 weeks in advance.
Changes may affect the price of your order.
NO CHANGES WILL BE ACCEPTED TO ORDERS AFTER THE 2 WEEK MARK.
Retainers
Orders totaling $100.00 or less, must be paid in full at the time of ordering.
Orders totaling more than $100.00 requires a 50% retainer at the time of ordering.
All orders must be paid in full amount 2 weeks prior to pick up/ delivery date.
All retainers are nonrefundable and nontransferable.
All retainers are final.
Rush orders
Rush orders are orders made the week of or the same day of event.
Orders can only be done IF there is an open spot and depending the size I
A $15 fee added to the total amount.
Standard delivery
We charge $1.25 per mile for delivery only in the city of Pensacola. This fee must be paid at the time of ordering.
Event Delivery
We charge $30.00 delivery and setup for all events in the city of Pensacola (5 miles from bakery). If you need delivery outside of 5 mile radius the fee is $1.25 per mile, on top of the $30 set up fee. We will coordinate the time with you – and schedule to meet you or your designee and set up your treats during our normal business hours. Delivery & setup outside of normal business hours and on holidays is available in most cases. Please inquire in advance if after hours delivery is needed. You need to be prepared to pay this fee in cash or by charge at least 14 days prior to your delivery date. We generally deliver within 2-1.5 hours before event in case of event changes, weather or emergencies. We do not place flowers, stands, table clothes or any other décor for your tables. This is your event planners responsibility.
Fees
* A $10.00 late fee will be placed on late pick up orders. We understand emergencies may occur, we ask that you call and let us know as soon as possible. In most cases, we can reschedule a pick up time. If the condition of the treats are compromised due to a late pick up, we are not held responsible and it may result in a cancellation. Please refer to our cancellation policy for more details.
A $10.00 disposal fee for non-pickups. You will not be able to order again unless fee is paid.
Cancellation
In the event of cancellation: You may cancel at any time for any reason. At that time, the contact will be null and void, but in that event, you will forfeit your retainer fee.
Picking up your cake/treats
Picking up your cake and/or treats is a great way to save money. If you choose to pick up your treats and/or cake you should and/make sure that you have a clean, flat surface to set treats and/or cake on while driving. We also recommend keeping your air conditioning on while traveling. Vans, sport utility and any vehicle that the back seat folds in so the air conditioning can make it to the trunk are the best for traveling. If you are in a car, the floor is generally safer than the seat. Some of our cakes are either too large or irregularly shaped to fit in a cake box so you need to take special care to protect them. Once you leave with the treat(s)/cake it is no longer the responsibility of The Baker Girls’ bakery. Nor are we responsible once they have been set up at the event site.
Caring for your product
We recommend cakes, cupcakes, fruits, cake pops or anything with icing or chocolate be displayed no more than ONE hour prior to serving. All are very heat sensitive, if displayed for a long period of time the products integrity is compromised. Cakes and/or treats needing refrigeration will be denoted on your delivery invoice, all are best served at room temperature. We are not responsible for treats/cakes once picked up or delivered, nor are we responsible for the treats/cakes once we have set them up at the event site.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

TERMS OF SALE
1. The contract between us
A contract between us and the customer will only be formed when goods are dispatched. When goods are dispatched this brings into existence a legally binding contract between us. We do not have to accept payments and can choose to cancel orders at any point before dispatch.
2. Price
You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website. If your address is in a remote location we will contact you with shipping options before your order is shipped if necessary. Some items may require overnight shipping .
3. Right for you to cancel
If you wish to cancel your order, the easiest method is to email TheeBakerGirl@yahoo.com . We also accept cancellation requests over the phone with required conformation of your order. Cancellations MUST be done within 24 hours of your purchase. Once order has reached processing it is no longer eligible for cancellation or refund.
Once you have notified us that you are cancelling your contract, any sum debited to us from your original method of payment will be re-credited to your account as soon as possible. All goods must be returned in accordance with our returns policy which can be found on each items policy. Goods made to the customer's own specification are not returnable.
4. Cancellation by us
We reserve the right to cancel the contract between us if:
We have insufficient stock to deliver the goods you have ordered;
We do not deliver to your area
Personal or health issues that prevent us from fulfilling your order
Order was not purchased correctly ; or
One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
Payment/delivery details could not be verified, or the order is considered fraudulent.
If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us via original method of payment , cash, invoice, or check as soon as possible but in any event within 14 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
we reserve the right to cancel or pause orders due to personal emergencies, weather,or sudden death.
If you cancel your order before it ships and the order is already made, a 10% restocking fee will be deducted from the total amount paid if you decide to cancel it for any reason. Credit card processors do not refund the credit card payment processing fees they charge companies like ours when a customer places an order if the customer decides to cancel for any reason. The restocking fee is to cover these fees. Please be sure you are ordering the correct product, if you by any chance order something that's not the correct item and your order has not shipped, email us and we will make the changes to your order and price . DO NOT PLACE ANOTHER ORDER WITH THE CORRECT ITEMS.
5. Local delivery of goods to you
Most goods will require a signature on delivery, therefore if you are not available for delivery you may need to contact us to re-organize delivery or to collect the goods from our shop if convenient.
if you choose to allow a third party to accept your order to deliver to you, you MUST email us or call. We reserve the right to check the ID of the party you choose to receive your order, we also reserve the right to withhold your items from your third party for any reason.
6. Payments
Where payment details are different to the billing address the order may be subject to enhanced security checks which can occasionally slow down dispatch. Please allow 24-48 hours for payment processing Monday - Thursday. Payments made Friday-Sunday can take 3-5 days to process. If any error occurs we will contact you directly. No item is shipped or made until payment(s) are processed.
7.Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be emailed to us and sent to our contact email at: TheeBakerGirl@yahoo.com you must include your name, order number, transaction id and date of order, and all notices from us to you may be displayed on our website from to time.
8. Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
9. Privacy
You acknowledge and agree to be bound by the terms of our privacy policy.
10. Entire agreement
These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
